Criminal History Records
The state of Utah is different from many other states when it comes to checking an applicant's criminal history. Although it is possible for employers to gain access to this information, they must take some extra steps.
Private business owners are allowed to run FBI background checks on job applicants. However, they may not request state or county criminal records.
Under the "Volunteers for Children Act," entities that provide for the "care, custody, or control" of children, the care of vulnerable adults, fiduciary trusts, and national security interests may request fingerprint-based national criminal history record checks for their employees and volunteers.
If an employer who does not fall under this exemption wants to review an applicant's criminal history, they must ask the applicants to obtain their own criminal record reports and provide them to the employer. Alternatively, the candidate can sign a release form that allows the report to be sent to a third party (the employer).
