According to current South Carolina marijuana law, the consumption, sale, and possession of marijuana are strictly prohibited for both recreational and medical purposes. However, in 2014, the state of South Carolina legalized the consumption of cannabidiol (CBD) products for qualifying patients under Julian's Law. With no further movement to legalize marijuana in the state of South Carolina, employers face minimal restrictions when conducting employee and applicant drug testing.

Medical Marijuana: Illegal

South Carolina currently does not enforce any marijuana laws that allow the consumption, sale, or possession of medicinal marijuana. In terms of medical marijuana laws in South Carolina, the closest the state has come is the approval of Julian's Law in 2014. This law allows qualified physicians to recommend cannabidiol products to patients suffering from severe epilepsy. Decriminalized: No

To date, there have been no successful efforts to decriminalize marijuana possession in the state of South Carolina. Subsequent offenders still face a misdemeanor charge, but face an enhanced punishment of up to a year in jail and a fine of up to $1,000.
