Laws and Regulations Relating to Substance Abuse in Spartanburg, SC
Up until recently, the state of South Carolina held no major laws that criminalized the trafficking of fentanyl. However, with an uptick in the number of fentanyl-related drug overdoses and criminal offenses in recent years across Spartanburg and the surrounding state, state lawmakers recently introduced a law creating new penalties for fentanyl traffickers to combat growing concerns.
In August 2023, Governor Henry McMaster signed HB 3503 into action to officially add fentanyl-related substances to the list of Schedule I controlled substances that the state considers a felony offense. Now, under updated state law, even first-time Spartanburg offenders found trafficking four to 14 grams of fentanyl can face at least seven years and up to 25 years in prison as well as a $50,000 fine, with penalties doubling with each recurring offense.
