The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone's DNA, can also be tested. An Alternative Specimen DNA Test is done by ordering one of our testing kits online and shipping the specimens back to us.

Why Establish Paternity in Port Orchard, WA?

Under Washington law, the biological father of a child will only gain immediate parental rights over the child if he is married to the child's mother at the time of the birth. For Port Orchard children born outside of a legally-recognized marriage, steps will need to be taken to establish paternity and declare a child's legal and biological father in order for the man to gain parental rights.

If either parent wishes to request monthly child support services, the state will also require the legal establishment of paternity before any requests can be processed. Once paternity is properly established in the state of Washington, a Port Orchard child can also receive benefits such as health insurance coverage, social security benefits, and military benefits from either parent party.

Methods of Establishing Paternity in Port Orchard, WA

Port Orchard parents can establish paternity in one of two ways. The first and easiest method is by signing and submitting an Acknowledgment of Parentage (AOP) form to a Kitsap County Washington Division of Child Support Services (DCS) Office. This method is typically used by parents who agree with the given paternity claim or have used DNA paternity testing to accurately identify a Port Orchard child's biological father.

In circumstances where a parent is unable to establish paternity due to the other parent refusing to complete an AOP form, paternity must be established through Kitsap County Family Court. During a court-ordered paternity establishment, a judge will request the presumed father undergo DNA testing so paternity can be properly established. From here, any necessary parenting agreements, such as child support orders, can be established as well.

Paternity Laws and Regulations in Port Orchard, WA

Under Washington State Code 26.26A.235, a Port Orchard parent may rescind an Acknowledgment of Parentage within 60 days of the form's filing. This action can occur if a parent learns that the previously presumed father is in fact not the child's biological parent following the use of DNA testing.

In the event that this 60-day mark expires, Washington Code 26.26A.240 states that the parent then has four years to commence a legal proceeding to challenge the acknowledgment in court. This proceeding must be on the basis of fraud, duress, or material mistake of fact.
