Laws and Regulations Relating to Substance Abuse in Omaha, NE

Following updates to Nebraska legislation in 2023, various agencies can now collaborate more effectively. This new coalition aims to share data regarding overdose fatalities and identify systemic shortcomings to mitigate future incidents.

The Douglas County Health Department has shared startling figures, indicating that in 2021, 214 Nebraskans died because of overdoses or drug poisoning. These data are believed to be underreported due to the stigma associated with drug use. One of the major problems in tackling this issue has been the confidentiality mandated by medical records protection laws, like HIPAA, which previously restricted the sharing of vital information.

However, with the passing of LB 227 in July 2023, those obstacles have been substantially diminished. The establishment of the Overdose Fatality Review Team (OFR) marks a new era where data previously confined to individual organizations can now be exchanged freely among stakeholders, including the Omaha Police Department and the Nebraska State Patrol, among others.

Dr. Leah Casanave from the Douglas County Health Department highlighted the significance of this change, emphasizing the newfound ability to consolidate data from various sources, which was previously impossible. This legislative change is a critical step forward in Nebraska's fight against the opioid crisis, enabling a more coordinated and informed response to drug-related deaths.
