Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the people being tested. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory. Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone's DNA, can also be tested. An Alternative Specimen DNA Test is done by registering online and shipping the specimens to us.

Legally Admissible DNA Tests vs. "Peace of Mind" At-Home Tests

A Legal Paternity Test is a court admissible DNA testing service. Accurate results for DNA paternity testing with 99.99% confidence or greater take about a week.

When deciding which type of DNA test is right for you, consider first what you might do with the results. In order for the results of a DNA test to hold up in court, for child support, or to change the name on a birth certificate, the test must be done at a clinic using strict chain of custody procedures. Our North Chesterfield DNA testing technicians are trained to follow guidelines that ensure that the results can be used for legal purposes.

Establishing Paternity in North Chesterfield, Virginia

In North Chesterfield and the entire state of Virginia, a child's biological father is not necessarily his or her legal father. According to attorneys at the Virginia-based DiPietro Law Group, there are several ways to establish legal paternity in Virginia. The easiest is to sign and file a Voluntary Acknowledgment of Paternity. However, this can only be done if both parents agree and there is no question about the true identity of the child's father.

If this isn't an option, one party will need to file a petition at the Juvenile and Domestic Relations District Court, located in Chesterfield. In this case, a judge will typically require a DNA test before making a ruling.

Regardless of how paternity is established, once a man is deemed the be the child's father, he will receive all the legal rights and responsibilities of fatherhood. This includes the requirement to pay child support and the ability to request visitation and/or custody.

Presumption of Paternity

Under Virginia law, if a North Chesterfield man and woman are married at the time a child is born or within 10 months prior, the man is automatically presumed to be the child's legal father. No further action is required to establish paternity. This "presumption of paternity" makes him legally obligated to provide financial support for the child, whether he remains married to the mother or not. However, if the man believes he is not the child's father, he can rebut this presumption. The easiest way to do this is by submitting a DNA test to the courts.

Putative Fathership Registry

If a man was not married to a child's mother within the 10 months prior to the birth and has not taken steps to establish paternity but believes he is the father of a child, he's known as a "putative father." In North Chesterfield, Virginia, a man can join a putative father registry. This will allow him to receive notification of any court proceedings related to the adoption of the child or termination of parental rights.
