In July 2021, Texas Governor Greg Abbott signed Senate Bill 768 into law to implement new state anti-fentanyl legislation. Fentanyl is a highly potent and deadly synthetic opioid responsible for many opioid overdose deaths across the state of Texas. The new legislation enhances criminal penalties for the distribution and manufacturing of fentanyl.

Under Senate Bill 768, the production or delivery of 4-200 grams of fentanyl has a minimum punishment of 10 years in prison and a maximum of life. Amounts of 200 to 400 grams now face a minimum of 15 years in prison, as well as 20 years for 400 or more grams. State officials hope this new legislation will act as a strong warning to local drug dealers and help reduce the frequency of opioid-related deaths.
