Laws and Regulations Related to Substance Abuse in Federal Way, WA

After a two-month pause to review the policy, the South County Outreach Referral and Exchange (SCORE) program in Seattle and King Counties resumed in May 2021. The program, which has been in place since 2009, allows IV drug users to exchange their used and dirty needles for clean ones and assists drug users with getting into treatment programs, receiving education, counseling, and more. Following the pause, it was determined that exchanges would only be provided at King County Metro Park & Ride locations and needles would not be distributed to teens.

Many members of the public disagree with the program, citing a significant uptick in the number of people passed out in the streets near Park & Ride locations and used needles littering parks, bus stops, and playgrounds. Federal Way Mayor Jim Ferrell said he also has concerns about the program but has no legal authority to ban it.

Local Government Efforts to Address Drug Problems in Federal Way

In an effort to curb the use of the dangerous drug fentanyl, the city of Federal Way passed a law in 2022 that makes smoking fentanyl in public a gross misdemeanor that's punishable by up to $5,000 in fines and up to one year in jail. Federal Way Mayor Jim Ferrell said the law is due in part to complaints received about the prevalence of second-hand fentanyl smoke on the city's public transportation. However, some argue that the law is redundant since possession of fentanyl without a valid prescription is already illegal under federal law.

Substance Abuse Trends and Statistics for King County, WA

Like much of the rest of the country, Federal Way and the rest of King County are suffering from a surge in drug overdose deaths. The number of overdose deaths in King County jumped 20% from 2019 to 2020 and another 39% between 2020 and 2021. By October 2022, there had already been 710 overdoses in King County, surpassing the total number that occurred in 2021. For all of the confirmed overdoses in 2022, 70% were related to fentanyl, a huge jump from less than 10%, which was the average prior to 2018.
