Nevada Background Screening

Background Check Laws Specific to the State of Nevada

In 2019, one lawsuit changed the way that many employers in Nevada use background checks for employment purposes. The case against Dollar General was brought forward by the Equal Employment Opportunity Commission (EEOC), who were able to prove that background checks had played a role in broad discrimination against African American applicants going back 15 years.

As a result of their imprecise use of background checks, Dollar General was forced to pay a $6 million settlement into a fund which will be split between the African American applicants who lost out on employment at the chain retailer between 2004-2019.

If used correctly, background checks should protect employers from liability. In Nevada, the federal Fair Credit Reporting Act(FCRA) requires employers to get the applicant's written consent before a background check can be conducted.

Specific state laws have been enacted in the last several years, including ban-the-box legislation that came into effect in 2018. The ban-the-box laws, which prevent employers from asking about an applicant's criminal record before the initial interview, only apply to public employees in Nevada, with some exceptions including firefighters and peace officers.

The Nevada legislature also prevented employers from relying on records for non-convictions that are older than seven years old. However, this prohibition doesn't apply to convictions, which means that any past conviction is visible on a criminal record check in Nevada, as long as it has not been sealed, which can happen in as little as a year post-case closure for some misdemeanors.
